Toleration
Service description
In Germany, politically persecuted persons are entitled to recognition as persons entitled to asylum (Basic Law Art. 16a). Anyone wishing to make use of this right must undergo a recognition procedure. The Federal Office for Migration and Refugees (BAMF) is responsible for carrying out the procedure. If this procedure is negative, the issuance of a residence title is not possible and the foreigners concerned are obliged to leave Germany. There is an enforceable obligation to leave the country, which must be carried out by means of deportation.
By means of the Duldung, which is a certificate of "temporary suspension of deportation", the enforcement of the obligation to deport can be waived for a certain period of time for factual, legal, urgent humanitarian or personal reasons.
